Welcome to the ca-va.be website - the place where you sell quickly and buy cheaply everything you need!

Whether you have new, vintage, or second-hand items for sale, you can display them on the ca-va.be website.

Please pay attention to these terms and conditions, as the services of the ca-va.be website can only be offered to individuals who agree to the following terms and conditions.

Terms used - explained in simple terms:

Site = the web page www.ca-va.be (and its moderators), including all its applications and sections

User = any individual and/or legal entity, at least 18 years old, accessing the ca-va.be website

Ad = a public offer launched by a User presenting a product or service for sale or rental

Seller = the User of the ca-va.be website offering one or more products and/or services for sale or rental

Buyer = the User of the ca-va.be website purchasing one or more products and/or services displayed on ca-va.be

Moderators = individuals who verify an Ad before or after its publication on the ca-va.be website

Terms and Conditions = this usage contract

Provider = the company SC BESCTPUBLICOBE.SRL, a company operating in accordance with Belgiann and European Union legislation, with its registered office at Strada Dealul zorilor nr1E, Bloc C1, Etaj 2 Ap. 28, registered with the Trade Register Office of the Iasi Court under no. J22/2012/06.06.2022, having the Unique Registration Code 46272321

Acceptance of conditions

The use of the ca-va.be website implies unconditional and full acceptance of these Terms and Conditions. By using the ca-va.be website, it is understood that this includes accessing, visiting, registering an account on the website, sending messages, and/or using the services to publish advertisements for the sale, purchase, or rental of a property on the website. Please take a few minutes to read them. We reserve the right to modify and update this page at any time. The Terms and Conditions page is permanently available.

2.  Any User who accesses the ca-va.be website and/or provides personal information through the forms available on the Site gives consent for their data to be collected and processed by the Provider for the optimal provision of services, as well as for marketing purposes, including direct marketing, while respecting and without prejudice to the rights of the data subject in the context of personal data processing, namely informing the data subject, the right of access to data, the right to intervene in the data, the right to object, the right not to be subject to an individual decision, and the right to appeal to the judiciary. Moreover, the User has the right to object to the processing of personal data concerning them and to request the deletion of data. To exercise any of these rights, the User can submit a written request, dated and signed, to the following address: Strada Dealul zorilor nr1E, Bloc C1, Etaj 2 Ap. 28, Iasi. Authorities may request certain information that may lead to the identification of a User, in accordance with applicable legal provisions.

Description of the services provided

ca-va.be is an online classifieds website where you can post ads for sale or rental, or search among ads already published by other Users.

3.1. Adding an ad

We, the ca-va.be project team, aim for all published Ads to be written correctly and in accordance with reality. For this reason, ad approval is not instant and they are verified by a specialized team who has the right to correct and publish them after these verifications or, if necessary, corrections. Please pay attention and follow the Posting Rules for an Ad, as we reserve the right to reject and/or delete ads that do not comply with these rules.

To add an Ad, a User must have an account on the ca-va.be website and be logged in, then fill out the form that opens when clicking the "Add ad" button. Please provide accurate contact information so that you can be contacted by Buyers or users who want more information about the product or service you are offering. The phone number provided in your account can be validated at any time, at no cost to you.

Phone number validation is mandatory for the "Real Estate" and "Jobs" categories. To validate a phone number, it must belong to a mobile phone network in Belgium. On a single account, you can validate as many phone numbers as you wish. A phone number validated on one account cannot be validated on another account associated with a different email address.

By submitting the ad for publication on the Site, you declare that you fully and unconditionally agree to all the clauses of this document.

The validity period of an Ad is 30 days from the moment of publication, with the possibility to extend this term. An ad can be instantly renewed, at a cost, multiple times. The prices for instant renewal vary depending on the category and the chosen payment method.

The maximum number of ads that can be published on a single account varies depending on the type of individual/legal person and the category in which the ad is posted.

3.2. Promoting an ad at a cost

There are 3 types of promotion packages:

Free Package

· Keep online for 30 days

Premium Package

· 7 days promotion

· Up to 10 images allowed

· Featured on the homepage

· Featured in the category

· Keep online for 60 days

Premium+ Package

· 30 days promotion

· Up to 15 images allowed

· Featured on the homepage

· Featured in the category

.· Keep online for 90 days

Ad Packages

These are the optimal choice if you have one or more ads to publish. The package types are available when selecting a category and are valid for 30 days. Ads that remain unused after 30 days are not carried over.

Individual Promotion Services

For extra visibility, you can choose the promotion service that suits you best. Whether you want to opt for instant renewal or promotion on the homepage, you start with the maximum chances of finding a buyer. Once you have decided on the best combination for your ad and chosen the payment method, you just need to follow the steps that will guide you to complete the payment.

Reactivation: Your ad will be activated for a period of 30 days.

The available payment methods are:

Debit/Credit Card: We accept Visa, Visa Electron, Mastercard, Maestro, Google Pay, and PayPal.

The invoice for the promotion service for one or more ads must be requested within a maximum of 15 calendar days from the transaction date.

In case a newly added ad with promotion does not comply with the Site's Terms of Use, it will not be published on ca-va.be. The amount paid for the ad promotion will not be refunded but will be credited to your ca-va.be account and can be used at any time to promote any active ad.

If the modifications made to an already displayed ad on ca-va.be are not approved by the Site's moderators due to non-compliance with the Terms of Use, the ad will remain published on the Site in its previously accepted form. If the displayed ad on Ca-va.be is modified and promoted at the same time, the ad will be displayed as Promoted immediately, but the modifications will be verified by Ca-va.be moderators. If the modifications are not approved by the Site's moderators due to non-compliance with the Terms of Use, the ad will remain displayed as Promoted but will be published on the Site in its previously accepted form. The amount paid for its promotion will not be refunded, as it has already been used for promoting that ad.

If a promoted ad, whose promotion has already started, is deactivated by the User before the promotion period expires or violates the Terms and Conditions of ca-va.be or is removed from the site due to reports received from ca-va.be users, the amount paid for the ad promotion will not be credited to your ca-va.be account as credit or refunded as money.

Example: Promoting an ad in the "Cars" category for a period of 7 days costs 5 euros.

If, due to technical reasons, the ad is not displayed in the Promoted Ads gallery throughout the 7-day period, the user cannot request a refund for the purchased promotion package or for the days when the ad was not displayed in the Promoted Ads gallery. We do not refund the amounts in cash but compensate for any discrepancies between the paid service and the duration of displaying the promoted ad in the user's ca-va.be account, or we refund the value of the entire promotion package to the ca-va.be account, depending on the unforeseen situation that occurred. The amount in the ca-va.be account can be used to promote the same ad or any other active ad.

b) Promotion of an ad on the ca-va.be homepage.

This type of promotion consists of displaying the ad in one of the 18 available positions on the ca-va.be homepage (desktop/laptop version only). The promoted ads will be displayed alternately, with each page reload, so that all promoted ads on the homepage receive the same number of impressions. The prices of the promotion packages on the homepage vary depending on the chosen category and display period.

Promoted ads on the ca-va.be homepage will not have the "Promoted" label, as is the case with Premium ads.

A user can purchase both types of promotion mentioned above for the same ad simultaneously.

3.5. Adding to "Favorites"

A user can save one or more ads in their account, in the Favorites list. The seller whose product/property/job offer has been saved as a Favorite by a potential buyer will be notified and will have the possibility to contact the buyer strictly through the messaging system of the ca-va.be website (without displaying the buyer's email address or phone number).

Similarly, a user can save one or more searches performed on the site as Favorites based on specific criteria of interest and will be notified when new ads appear that match the chosen criteria in the saved search.

4.The entire content of the ca-va.be page, including images, texts, graphics, the published ad on the site for which the seller grants the non-exclusive right of use to the provider, applications, links, and any other audio-visual content, as well as the graphic design, source code, and any other data and information belong to the Site, the Provider, and its affiliates. This information is protected by copyright law and laws related to intellectual and industrial property rights. The information published on ca-va.be cannot be published, transmitted, or copied by any means without the written consent of the legal representative of the Provider. Failure to comply with these conditions is punishable by law.

By posting an ad on the ca-va.be website, you affirm, guarantee, and support that you own all copyright rights for images, text, and content, and you do not infringe on the intellectual property rights of any third party. You are solely responsible for everything you post and the consequences of publishing an ad.

By publishing the ad on the ca-va.be website, you agree to grant the Provider a free, unlimited, and irrevocable license, through which you transmit to the Site all rights over the posted material. Additionally, you agree that the ads published on the ca-va.be website may be made available to the public by the Provider on all or any of its online platforms and through any other means, such as television, radio, banners, the Internet, billboards, or press releases.

Limitation of Liability

We strive to provide you with the best service, but we cannot promise that it will be perfect. Therefore, we cannot offer any guarantee that the ca-va.be website will be continuously available or error-free. Regarding the materials you post on ca-va.be, we remind you that you are directly responsible for the content and accuracy of such materials. The Provider, the ca-va.be website, and/or its moderators do not guarantee in any way the availability, quality, quantity (or any other aspects) of the products or services that are the subject of the Ads, and they assume no responsibility for the accuracy of the Ads displayed on ca-va.be. In no event shall the Provider, the ca-va.be website, and/or its moderators be liable for any direct, indirect, incidental, or consequential damages resulting from the inaccuracy of the content, errors, losses, or any kind of harm arising from the use of any posted content, transmitted by email, or otherwise made available through the Site. Additionally, the Provider, the ca-va.be website, and/or its moderators shall not be liable for any activities with apparent illegality conducted by Users, especially for providing inaccurate content or data regarding the product or service that is the subject of an Ad and/or the content of conversations conducted through the messaging system on the Site.

In the event of a conflict, please contact us, and we will seek an amicable resolution in accordance with applicable regulations. In case of an escalation of the conflict and if the amicable resolution fails, it will be necessary to resort to the competent judicial authorities.

5. For your safety, we recommend that you always check information related to contests and campaigns organized by us on our page www.ca-va.be or on the official Facebook page, facebook.com/ca-va.be.

Posting Rules and Code of Conduct on the Ca-va.be Website

In order to create a place where everyone can come back with pleasure, whether for shopping, selling, or renting, the Moderators of the Ca-va.be website will remove false, incomplete, or incorrect ads. Therefore, the approval/publication of ads is not done automatically and instantaneously but rather before and/or after publication on the site. To avoid an unpleasant situation where an Ad is rejected, we have created some Posting Rules and a Code of Conduct on the ca-va.be website that we kindly ask you to consider.

Although you can sell almost anything on ca-va.be, and we believe in "second chances," there are still a few products that you cannot sell here. Here's what it's about:

*** Cigarettes, cigars, rolling papers, tobacco, drugs of any kind.

*** Weapons and lethal ammunition, non-lethal self-defense weapons that can cause injury, tranquilizer guns, stunning devices, pellet or airsoft guns, electric shock devices, and related products according to

*** Explosive or pyrotechnic materials, as well as other objects hazardous to health.

*** Medicines, medical and pharmaceutical products (for humans or animals), blood, human organs, aphrodisiacs, nutritional supplements, steroids, proteins, supplements for athletes, weight loss products, as well as any other goods that can be dangerous to human health and life.

Although you can sell almost anything on ca-va.be, and we believe in "second chances," there are still a few products that you cannot sell here. Here's what it's about:

*** Cigarettes, cigars, rolling papers, tobacco, drugs of any kind.

*** Lethal weapons and ammunition, non-lethal self-defense weapons that can cause injury, tranquilizer weapons, stunning weapons, pellet or compressed air weapons, electric shock devices, and related products.

*** Explosive or pyrotechnic materials, as well as other objects hazardous to health.

*** Medicines, medical and pharmaceutical products (for humans or animals), blood, human organs, aphrodisiacs, nutritional supplements, steroids, proteins, supplements for athletes, weight loss products, and any other goods that can be dangerous to human health and life.

*** Erotic and obscene materials, sex shop products, dating services, erotic massage services, escort services, video chat, as well as job offers for dancer positions, club entertainers, disguised job offers referring to/implicating sexual activities.

*** Items obtained through theft, fraud, or other types of crimes.

*** Goods located outside the country (e.g., cars, agricultural machinery, real estate).

*** Endangered animals. Convention on International Trade in Endangered Species of Wild Fauna and Flora, adopted in Washington on March 3, 1973.

In the context of the intensified electronic commerce activities and considering the relevant legislative provisions at the European and national levels, specifically Directive 31/2000 on certain legal aspects of information society services, particularly electronic commerce in the internal market (Directive on electronic commerce), and the specific ones in the veterinary and food safety field, namely Regulation (EC) No. 178/2002 establishing the principles and general requirements of food law, establishing the European Food Safety Authority and laying down procedures in the field of food safety, as well as Regulation (EU) No. 675/2017 on official controls and other official activities to ensure the application of food legislation, feed legislation, health and welfare rules for animals, plant health, and plant protection products, and the Government Ordinance No. 42/2004 on the organization of veterinary and food safety activities, approved by Law No. 215/2004, it is necessary for all operators selling live animals and food products online (individuals or legal entities) to comply with the applicable legislative requirements in these areas.

Furthermore, in accordance with the provisions of the Order of the President of the National Sanitary Veterinary and Food Safety Authority No. 111/2008 approving the Veterinary and Food Safety Standard regarding the procedure for sanitary veterinary registration and registration for food safety of activities related to the production and direct and/or retail sale of food products of animal or non-animal origin, as well as activities related to the production, processing, storage, transport, and commercialization of non-animal origin food products, with subsequent amendments and completions, it is necessary for online sales units to be registered for sanitary veterinary and food safety and to hold a document of sanitary veterinary registration and registration for food safety issued by the Sanitary Veterinary and Food Safety Directorate of the county or Bucharest municipality where the operator carries out its activity.

For these situations, both online sales units and the platforms through which they are sold are operators in the food sector, and the administrators of the online platforms must ensure that all those who benefit from the allocated space for promoting food products are registered as operators in the food sector and comply with the above-mentioned legislative requirements.

***Companion animals (especially dogs of the Pit Bull, Boerboel, Bandog breeds, and their crossbreeds) whose sale violates Belgiann and European legislation in this field.

***Starting from August 1st, 2019, advertisements offering pets for breeding/mating will not be accepted.

***Badger fat, bear fat, viper venom, green coffee, ganoderma coffee, Tibetan mushroom, kefir, kombucha.

***Music, movies, software, or other goods that infringe upon copyright and intellectual property rights, products with a registered trademark within the European Union.

***Products bearing the "popsocket" or "popsockets" brand, regardless of the context, or copies of this type of product, even if they have a different name. Expressions such as "product type/similar to popsocket" will not be accepted.

***Spy devices for computers/laptops, headphones, and other cheating gadgets, devices for disrupting car locks (jammers).

***Vehicle documents, chassis numbers, license plates, diesel fuel.

***LED or gas-discharge light sources that emulate filament light sources of different international categories. These types of products cannot be sold as they do not comply with the provisions of Regulation 10 ECE-UN concerning electromagnetic compatibility, which states that light sources must not be mechanically interchangeable as long as the method of generating the light beam differs. Example: LED H1, LED H3, LED H4, LED H7, LED H11.

***Fortune-telling services, tarot readings, clairvoyance, white magic, or similar services.

***Usury, pawnshop services, loans, or similar activities.

***iCloud unlocking services.

***Particle filter (DPF), FAP, EGR, SCR, DTC, O2, ADBLUE removal/cancellation/resolution services ("FAP removal" or "DPF resolution" or "ADBLUE OFF," etc.).

***Online job offers that promise to make money by sitting in front of a computer.

***Offers for obtaining a temporary address registration or issuing identity cards.

***Rental offers for real estate properties exclusively targeting females.

***Thesis/dissertation writing services or assistance.

***Gambling, virtual transactions, gambling account services, Filelist invitations.

***Non-existent goods, any other illegal products or activities.

This list will be constantly updated, so please consult it before posting an ad to avoid the unpleasant situation of having your ad rejected.

In addition to the list of prohibited products and services, we also have a few rules of conduct that we kindly ask you to consider:

*** Please publish ads in the official language of the country and use appropriate language.

*** Only one ad for the same product or service is allowed. Duplicate ads will be rejected or removed from the site. If you are selling products or services as a package or bundle, please mention it in the description.

*** An ad is valid for a single product or service. Please publish multiple ads if you are offering multiple products or services for sale.

*** If you deactivate an ad with the intention of reposting it, the new ad will not be accepted and will not appear on the site. Instead, you can reactivate the deactivated ad, which can be found in the Deactivated Ads list.

*** An ad published in one county is visible throughout Belgium and neighboring counties, so it is not necessary (and will not be accepted) to publish the same ad in multiple counties.

*** Please do not disclose personal data in the ad description (ID card number, bank account, etc.) or provide premium rate phone numbers as contact information, as these ads will not be accepted.

*** Please use capital letters only where necessary, such as at the beginning of the title and for the names of brands. Titles written entirely in capital letters will be changed to lowercase by the moderators of the ca-va.be website. Additionally, irrelevant words for the advertised product or service (e.g., sell, offer, urgent, etc.) and advertisements for blogs, websites, or stores within the country will be removed from the title.

*** Please publish ads that fit into the categories of the website. We only accept ads for selling/renting a product, service, or property, not requests.

*** Please do not add humanitarian ads, ads denouncing thefts or lost/found objects or animals, or ads promoting blogs/social networks/websites that need traffic, as they will not be accepted.

*** Please do not add links to other websites in your ad's title or description, as the moderators of the ca-va.be website have the right to delete them.

*** Ads that may make users of the ca-va.be website feel discriminated against based on race, nationality, language, religion, sex or sexual orientation, ethnicity, illnesses, or belonging to a disadvantaged category will not be published.

*** Adding catalog-type images within an ad is only permitted if you include at least one photo taken by you that is representative of the product or service being offered.

*** If an ad is modified and the product or service within the ad has been replaced, the modification will be rejected, and the ad will continue to be visible on the site in the form in which it was previously accepted. This rule also applies if an ad is edited but the modifications violate any of the present rules, in which case they will be rejected by the moderators of the ca-va.be website, and the ad will be maintained on the site in the form in which it was previously accepted.

*** Up to a maximum of 5 ads in the Real Estate category are allowed per Individual account. Users who have added more than 5 ads in the Real Estate category on a single account will be considered legal entities; therefore, we reserve the right to change the Account Type from Individual to Company for those accounts.

*** The services offered must comply with applicable laws and regulations in Belgium

Rules regarding the TITLE of the ad:

· For ads in the Real Estate category, it is mandatory for the title to contain the type of property, number of rooms, and area (for Apartments, Studio Apartments, Houses, Commercial Spaces) and the area for Land.

· For ads in the Auto-Moto-Nautic category, it is mandatory for the title to contain the brand and model of the vehicle.

· For ads in the Jobs category, it is mandatory for the title to contain the type of job offered.

· Titles written in all capital letters will be replaced with lowercase letters by the moderators of the ca-va.be website. Additionally, irrelevant words for the product or service being sold will be removed from the title (e.g., sell, offer, urgent, etc.).

Rules regarding IMAGES:

*** Adding catalog-type images within an ad is only permitted if you include at least one photo taken by you that is representative of the product or service being offered.

*** The images used must be clear and reflect the current condition of the product or property being sold.

*** Images that are unrelated to the product/property/service being sold will be deleted by the moderators of the ca-va.be website.

*** Images that contain watermarks, logos, or other signs of competing websites will be deleted by the moderators of ca-va.be.

*** The images used must not have any restrictions and the use of images that infringe on the rights of third parties, particularly intellectual property rights of third parties, is prohibited.

*** Ads posted in the Real Estate category by a Company User must contain at least one real image or a sketch as follows:

- In the Apartments and Studio Apartments subcategories, the image must be mandatory from inside the apartment and/or a sketch.

- In the other subcategories (Houses, Land, Commercial Spaces, Other types of spaces), the image can be from outside the house/commercial space or a sketch.

Eligibility, Registration, and Cancellation

· The ca-va.be website is intended for individuals and/or legal entities who are at least 18 years old and have full legal capacity.

· Creating an account on the ca-va.be website can be done either by registering with a Facebook or Google account or by using an email address and password. By registering, the User confirms that they are at least 18 years old. The profile information created on the ca-va.be website must be real, complete, and up-to-date. Multiple registrations with the same email address are not allowed.

· Sending messages through ca-va.be is possible by creating an account on the website and implies the User's acceptance in this regard.

· Authentication data is confidential. We recommend taking precautionary measures and choosing a strong password that you don't share with anyone.

· If, for various reasons, you wish to cancel your account on the ca-va.be website, send us an email at office@ca-va.be and we will deactivate your account, and all your ads will be removed from the Site. After deactivating the account, we may retain information regarding the content you have published for a period of 12 months. In this case, according to the privacy policy and personal data protection, the Site may provide details regarding an Ad (regardless of their nature) only to competent authorities, upon an official request received from them.

· After deactivating the account and removing all ads from the site, we cannot guarantee the immediate removal of search results on search engines. Search engine indexing is independent of the ca-va.be website.

7. We reserve the right to delete or edit any Ad that does not comply with the Terms and Conditions in any way or receives reports from users of the site. We also reserve the right to block or deactivate an account if we receive repeated reports regarding one or more ads that do not comply with the mentioned provisions in this document, whose content is not in line with reality or violates any other legal provision and may harm the security of activities of other users of the ca-va.be website.
